Standard Terms and Conditions for ELS Inc. Transportation

This Service Agreement serves as a contract between ELS and the customer. The terms and Conditions of this Service Agreement are as follows.

Booking Policy

  • All bookings require a minimum of 2 days' notice
  • Reservation will only be confirmed upon receipt of a deposit of 30% of the total cost of the requested service.
  • The remaining balance must be settled within 48 hours after the scheduled service.
  • Submitting an inquiry does not constitute a booking, as all bookings are subject to confirmation by us.
  • We will send you a written confirmation via email or SMS to ensure that all details are correct and agreed upon once the booking has been confirmed.
  • It's important to note that all rates are calculated in the local currency and will be billed in the USD using the prevailing exchange rate at the time of payment.

Payment

  • ELS Inc. uses a third-party payment processor to link your credit card account to pay for the online booking services.
  • ELS is not authorized to store any credit card details within the application.
  • The remaining balance must be settled within 48 hours after the scheduled service.
  • Online payment processing charges will be applicable to every transaction.
  • ELS Inc. is not responsible for any errors by the payment processor.

Base Rate

  • The rate charged for basic transportation services to the client is charged before any additional fees or taxes are applied.
  • Fees may include a gratuity for the driver, STC fees, fuel surcharges, airport fees, international arrival fees, incidental charges, and/or taxes, depending on the nature of the service provided and the local regulations.

Estimated Inclusive Quote

  • Any rates quoted prior to the commencement of our services are only an initial estimate of the total cost of the reserved services.
  • The final price may vary based on a number of factors, including wait time and/or additional services that may be requested during the course of the reservation.
  • If any unforeseen circumstances arise that can impact the final cost of the service.
  • Our team is committed to notifying clients of any changes to pricing as soon as possible.

Cancellations & Charges Policy

  • For any cancellations in New York City, a minimum of two hours (2 hours) will be charged at an hourly rate of $85 USD.
  • For cancellations made less than three hours(3 hours) before the scheduled pick-up time, you will be charged the full fare.
  • For pickups in the outer boroughs of Queens and the Bronx, please note that the minimum cancellation time is three hours(3 hours), and the hourly rate is $85 USD.
  • In the event of a cancellation at the pickup location, you will be charged the full fare as well, plus tolls if any
  • For out-of-town pickups in areas such as NJ, CT, LI, NYS, etc. the minimum cancellation is three hours(3 hours), and the hourly rate is $105 USD. Please note that the time starts in NYC and ends in NYC.
  • Any cancellation less than four hours (4 hours) before pickup time will be charged for three hours (3 hours), and the hourly rate is $105 USD.
  • If you cancel on scene at the pickup time, you will be charged a minimum of three hours (3 hours) plus additional time calculated going back to NYC.
  • Cancellations for Sprinter luxury van and bus services require at least three days (3 days) notice from the date of service.
  • Cancellations made with less than three days’ notice will be charged the full contract amount. If no contract exists, the hourly minimum for the vehicle will be charged in the event of a cancellation.

Pickup, Change, and No-Show Policy

  • The client must specify the exact time and date of pickup. The pickup time should be scheduled in advance to ensure the availability of the vehicle.
  • The client must provide the exact pickup location, including the street address, building name, and any specific directions or landmarks that will help the chauffeur partner locate the pickup.
  • Any changes to the pickup time or location must be communicated to the service provider as soon as possible.
  • Changes made within 24 hours of the scheduled pickup time may be subject to additional fees.
  • If the client fails to appear at the designated pickup location at the scheduled pickup time and if there is no contact with the client the chauffeur partner will wait for up to 30 minutes before considering the client a No-Show.
  • In the event of a No-Show, the client will be charged the full cost of the reservation.
  • The No-Show fee will be equal to the hourly minimum or base transfer rate for the confirmed vehicle, plus any applicable airport fees, fuel surcharges, tolls, and parking fees.
  • To avoid any Change fee, Late Cancellation fee, or No-Show fee, we ask that you make any changes or cancellations to your reservation(s) in accordance with the cancellation policy noted in your email confirmation. You may either call +1 929 919 3901 or cancel the reservation at our website, www.els.luxury.

Wait-Time

  • ELS Inc. will provide a complimentary wait time of up to 15 minutes for all pickups.
  • For additional wait time beyond the complimentary 15 minutes, ELS Inc. will charge a wait time fee.
  • The wait time fee will be based on the hourly rate for the confirmed vehicle.
  • For additional wait time, the customer should communicate this to our service provider as soon as possible.
  • Additional wait times may be subject to vehicle availability.

Extra-Stops

  • For services that are not charged at hourly rates, customers are allowed to make one stop along the route, provided that it doesn't exceed fifteen (15) minutes.
  • If the stop takes longer than fifteen minutes, the customer will be charged the transfer base rate plus the hourly rate for the vehicle in increments of fifteen (15) minutes, up to a maximum of forty-five (45) minutes (rounded up) for the waiting time of the chauffeur partner.
  • The wait time fee will be based on the hourly rate for the confirmed vehicle.
  • For additional wait time, the customer should communicate this to our service provider as soon as possible.
  • If there is more than one stop, or if the one stop exceeds thirty (30) minutes, then the trip will be charged at an hourly rate.

Non-Availability

While we do everything in our power to provide a safe and comfortable journey, some factors are unpredictable and out of our control. We cannot be held liable for any such circumstances beyond our control, including but not limited to weather, road conditions, and breakdowns. We apologize for any inconvenience this may cause and appreciate your understanding in such situations.

Complementary

At ELS Inc., we understand that staying connected is important. That's why we are pleased to offer Complimentary Wi-Fi service in many of our vehicles, so you can stay connected and productive during your journey. Any passengers who utilize the complimentary Wi-Fi in-vehicle understand and agree that there are significant security, privacy, and confidentiality risks inherent in accessing or transmitting information through the Internet, whether the connection to the Internet is facilitated through wired or wireless technology. These security issues range from the interception of transmissions to the loss of data or the introduction of viruses or other programs that can damage your device or network.

Accordingly, all passengers agree that ELS Inc., its subsidiaries, affiliates, parents, owners,Investors and insurers will not be liable for any interception of transmissions, loss of data, file corruption, hacking or damage to your computer or network that results from the transmission or download of information or materials through the service

Safety Belts

At ELS Inc., we take passenger safety very seriously. We require all passengers to comply with local laws and regulations regarding safety belts and other safety equipment to ensure a safe and comfortable journey for everyone on board.

Child Safety Seats

We understand that your children's safety is of utmost importance. Due to safety reasons, please note that we do not provide child safety or booster seats. Instead, customers are welcome to bring and install their own age- and weight-appropriate equipment to ensure the safety of their children. We appreciate your cooperation and understanding in helping us maintain a high standard of safety for all of our passengers

Insurance Policy

We prioritize the safety and well-being of our customers. As such, we provide auto liability insurance for all of our services, which is procured in the market where the service is rendered. Our auto liability insurance coverage is no less than the statutory minimum required by law in that market. This ensures that our customers have the necessary protection in case of any unforeseen incident during their journey with us.

Lost or Misplaced Items

ELS Inc. assumes no liability for any lost or misplaced personal property or other items. All property and/or your belongings remain the client’s or passenger’s responsibility at all times. We accept no responsibility or liability for any loss or damage, no matter how caused, to your property. .

Pets and Service Animal Regulation

We are always here to help and provide you with the best possible service. We are committed to providing a comfortable journey to all passengers, including those who travel with animals. Kindly note that animals may only be transported in a kennel or soft-sided pet container. .

For passengers with disabilities traveling with a service animal, we understand that the animal may not require a kennel or soft-sided pet container. As such, we welcome service animals to travel with their owners without a kennel or container.

Chauffeur Conduct

We prioritize the health and safety of our chauffeur partners and customers. As such, we maintain a strict zero-tolerance policy with regard to drug and alcohol use in our workplace and/or services. .

We are committed to providing a safe and comfortable environment for all passengers, and we believe that the use of drugs and alcohol can compromise their safety. Therefore, we do not tolerate any use of drugs or alcohol by our chauffeur partners or customers while on the job or using our services. If you suspect any behavior of the chauffeur partner to be under the influence of drugs or alcohol, we urge you to report us immediately. We take the issue very seriously.

Smoking Prohibition

We ask that all passengers respect this, that all our vehicles are nonsmoking. To ensure the health and well-being smoking is strictly prohibited in all of our vehicles.

Safety and Damage

To ensure this, our chauffeur partners must abide by all traffic laws and regulations, including speed limits and the right of way, at all times. Even in the event of an emergency, our chauffeur partners are prohibited from violating the highway code.

Additionally, ELS Inc. reserves the right to charge for any damage caused by smoking, excessive spillage, or passengers who vomit in our vehicles. The fee may vary depending on the amount of cleaning and downtime required to restore the vehicle to its previous condition.
